Last updated: 1 January 2025
1. Introduction
Sam Freight & Logistics Pty Ltd (ABN 75 703 152 112) is committed to protecting the privacy of our clients, suppliers, website visitors and other stakeholders. This Privacy Policy explains how we handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). The policy applies to all services provided by Sam Freight & Logistics Pty Ltd, including road freight, linehaul transport, palletised freight, warehousing and third-party logistics services across Melbourne VIC and Australia-wide.
2. The Australian Privacy Principles
We comply with the thirteen Australian Privacy Principles set out in Schedule 1 of the Privacy Act 1988 (Cth). These principles govern the collection, use, disclosure, storage, security and disposal of personal information, as well as access to and correction of that information. Where this policy is silent on a matter, the APPs apply.
3. What personal information we collect
The types of personal information we may collect include:
- Contact details, such as your name, business name, email address and delivery or collection address;
- Details of enquiries, quotes and bookings, including freight specifications and scheduling preferences;
- Billing and payment information necessary to provide invoicing for our services;
- Consignment and tracking information required to move your freight safely and lawfully;
- Communications with us, including emails sent to ceo@samfreightlogistics.online.
We do not collect sensitive information (such as health, racial or religious information) unless it is reasonably necessary for a permitted purpose and you have consented.
4. How we collect personal information
We collect personal information directly from you where reasonably practicable, for example when you submit a quote request through our website, send us an email, or engage our freight and logistics services. We may also collect information from third parties where it is unreasonable or impracticable to do so directly, such as from your nominated freight agents, referrers or from publicly available sources.
5. Purposes for which we collect, use and disclose information
We collect, hold, use and disclose personal information for purposes including:
- Providing freight and logistics services, including arranging transport, consolidation and delivery of consignments;
- Preparing quotes, managing bookings and communicating with you about your shipments;
- Invoicing, credit management and debt recovery;
- Meeting our legal, regulatory and safety obligations, including chain of responsibility requirements under Australian transport law;
- Improving our services and managing our business operations.
We will not use or disclose personal information for direct marketing without meeting the consent and opt-out requirements of the APPs, and we will not sell your personal information.
6. Disclosure to third parties
In the course of moving freight, we may disclose personal information to subcontracted carriers, freight partners, customs brokers, warehouses and other service providers engaged to deliver your consignment, as well as to our professional advisers and to government agencies where required or authorised by law. Where we disclose information to third parties, we take reasonable steps to ensure they handle it in a manner consistent with this policy and the APPs.
7. Overseas disclosure
We generally store personal information on servers located in Australia. If we engage overseas service providers or disclose personal information to recipients outside Australia, we will take reasonable steps to ensure those recipients do not breach the APPs, in accordance with APP 8.
8. Security of personal information
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These steps include access controls on our systems, secure handling of electronic records and appropriate staff practices. When personal information is no longer required for the purposes for which it was collected and we are not required by law to retain it, we take reasonable steps to destroy or de-identify it.
9. Access to and correction of your personal information
You may request access to the personal information we hold about you, and request correction of information that is inaccurate, out of date, incomplete, irrelevant or misleading. We will respond to requests within a reasonable period. In some circumstances permitted by the Privacy Act, we may decline a request, in which case we will provide written reasons and information about how to complain.
10. Anonymity and pseudonymity
Where lawful and practicable, you have the option of dealing with us anonymously or under a pseudonym. However, because our freight and logistics services require consignment details, addresses and billing information, it is usually not practicable to provide services anonymously.
